Our client, a patrol officer, was transporting two prisoners on March 17, 2012to the courthouse when one of the prisoners kicked out the window of the vehicle and leapt out while it was still in motion. Our client called for help while protecting the escaped prisoner, who was laying down in the road, before the prisoner got back up and attempted to run to another vehicle. After an unsuccessfully attempting to pepper spray the fleeing man, our client fired two shots at the prisoner in order to prevent him entering a nearby residential area.
While the prisoner survived, our client’s first thought was that he just killed someone’s father – he had just become a father himself. He was placed on administrative leave for two weeks, and during that time was diagnosed with PTSD after experiencing trouble sleeping, irritation, anxiety, and feeling distant from his child.
In the initial arbitration ruling, the arbitrator found that our client’s condition had stabilized as of August 1, 2013, noting that he had not sought additional treatment since March of that year. However, our firm fought to modify that decision, explaining that he had stopped receiving treatment because the medical bills were not paid through his workers’ compensation coverage, and he could not afford the bills on his own. Through our efforts, we successfully secured an extension on his total disability benefits through May 4, 2014, the day before he began a new job as a security assistant with a school district after leaving his position as a police officer due to PTSD.
