Client Strikes Abandoned Vehicle, Recovers $100,000 Uninsured Motorist Settlement

Morici, Longo & Associates secured a settlement of $100,000 for their client, a man driving home from work as a union electrician in the early morning hours, when he struck a vehicle that had been abandoned in the left hand lane of an expressway. The forceful impact caused the client to suffer fractures of his leg, arm, and lumbar vertebrae and undergo multiple surgeries.

The driver that abandoned the vehicle and the vehicle’s owner were later determined to be uninsured. Fortunately, the client carried Uninsured Motorist (UM) Coverage that Morici, Longo & Associates was able to make a claim against.

The Underinsured Motorist insurance carrier did not accept liability easily and hired an accident reconstructionist to retrieve the electronic data recorder from the client’s wrecked car, which revealed him to be traveling approximately 10 miles per hour over the speed limit. Nevertheless, Morici, Longo & Associates was able to argue that the collision with the abandoned vehicle would have occurred even if the client was traveling at the speed limit, and that his damages exceeded the available policy limits of $100,000 even if the client was considered to be 50% at fault for the collision. Eventually, the insurance carrier agreed to tender the full UM policy limits of $100,000.00.
