Amazon Injury Claims in Chicago
Amazon Is Not an Ordinary Opponent. Neither Are We.
Amazon is a trillion-dollar corporation with experienced legal and claims management teams. Whether you are an injured motorist dealing with an Amazon delivery vehicle claim or an injured worker navigating a workers' compensation dispute, you are not dealing with an ordinary opponent. Amazon, its delivery partners, and their insurers may use experienced claims professionals and defense attorneys to investigate liability, evaluate coverage, and limit the amounts paid on disputed claims.
At Morici, Longo & Associates, we level the playing field. We have spent more than two decades representing injured individuals and families against large corporations like Amazon, and we know what it takes to effectively counter them.
We are not intimidated by the size of the opponent, and our track record of recovering hundreds of millions of dollars for our clients reflects what happens when an injured person has equally experienced, equally determined counsel on their side.

Amazon Delivery Vehicle Accidents in Chicago
Some of the most common serious-injury claims involving Amazon stem from collisions with delivery vehicles. Amazon operates an extensive delivery network, with a constant flow of vans, sprinter vans, and cargo vehicles often under significant time pressure.
Common causes of serious Amazon delivery vehicle accidents include:
- Excessive speed
- Failure to obey traffic signals and stop signs
- Failure to keep a proper lookout
- Improper turns
- Unsafe backing maneuvers
- Distracted or fatigued driving
When a collision involves a delivery van or other commercial vehicle, its size and weight may increase the risk of serious injury, particularly for occupants of smaller vehicles, cyclists, and pedestrians.
Who Is Legally Responsible?
Amazon uses multiple delivery models, and the identity of the responsible party (and the applicable insurance coverage) depends on which model was involved in your accident.
Amazon Delivery Service Partners (DSPs)
DSPs are independent business entities that Amazon uses to handle last-mile delivery. DSP drivers operate Amazon-branded vans and wear Amazon uniforms, but they are technically employed by the DSP, not Amazon.
If a DSP driver negligently causes a collision while acting within the scope of employment, the driver and the DSP employer may be legally responsible, subject to facts, available defenses, and applicable insurance coverage.
Whether Amazon can be held directly or vicariously liable for a DSP driver's negligence depends on whether Amazon exercised sufficient “right to control” over delivery operations under agency law, or whether Amazon engaged in negligent selection, retention, or supervision of the DSP entity.
Amazon Flex Drivers
These are independent contractors who use personal vehicles to make deliveries through the Amazon Flex program. These drivers may carry personal auto insurance, commercial auto insurance, or both, and Amazon may also provide coverage under certain conditions.
Amazon provides commercial auto liability coverage (up to $1 million) to active Flex drivers during an assigned delivery block in most states, including Illinois, provided the driver maintains a valid personal auto policy. The coverage available after a crash (and whether Amazon’s policy, the driver’s personal policy, or another policy responds) depends on the timing of the collision, the type of loss, applicable exclusions, and the policy terms.
What Damages Can You Recover?
If another party was legally responsible for a collision involving an Amazon delivery vehicle, you may be able to seek compensation for proven losses such as:
- Past and future medical expenses
- Lost wages and diminished earning capacity
- Pain and suffering
- Property damage
Illinois law provides avenues for holding companies responsible for the conduct of their agents and contractors in certain circumstances. Morici, Longo & Associates will thoroughly investigate the case to identify every source of accountability and compensation, and we will work with medical experts and financial specialists to calculate and pursue every component of your damages.
Amazon Warehouse & Fulfillment Center Injuries in Illinois
Most employees who suffer work-related injuries in Illinois are covered by the Illinois Workers’ Compensation Act. For Amazon on-the-job injuries, the identity of the responsible employer may require closer review when the worker was hired through a contractor, Delivery Service Partner, or another third party.
Illinois workers' compensation is a no-fault system that does not require an employee to prove employer fault. However, to secure benefits, an employee must establish that the injury arose out of and in the course of employment and satisfy mandatory statutory notice requirements; specifically, by notifying the employer within 45 days of the accident under 820 ILCS 305/6(c).
Important information for employees hurt at an Amazon warehouse:
- You have the right to file a workers' compensation claim, and under the Illinois Workers' Compensation Act (820 ILCS 305/4(h)), it is unlawful for an employer to discharge or discriminate against an employee in retaliation for exercising their workers' compensation rights.
- Amazon or the worker’s direct employer may use a third-party administrator to investigate and manage the workers’ compensation claim. The employer and its claims administrator will evaluate whether the injury is compensable and whether particular medical or disability benefits are owed. Because their interests may differ from yours, legal guidance can be valuable when a claim is disputed or benefits are delayed.
Common Warehouse Injuries
Injuries we represent in Amazon warehouse and fulfillment center workers' compensation cases include:
- Forklift and powered industrial truck accidents, which can cause severe crush injuries, fractures, and traumatic injuries
- Conveyor system injuries, including entanglement and crush injuries from automated machinery
- Slip and fall accidents from wet floors, debris, or uneven surfaces in high-traffic warehouse environments
- Injuries from falling merchandise or products from storage racks and shelving
- Repetitive stress and overexertion injuries from the high-volume lifting, sorting, and packing demands of fulfillment center work
- Loading dock accidents involving delivery vehicles, heavy freight, and the physical hazards of loading and unloading operations
Third-Party Claims for Warehouse Workers
In some warehouse injury cases, a third party may share responsibility for the injury.
If a defect in machinery or equipment caused or contributed to the injury, the worker may have a separate product liability claim against a manufacturer, distributor, or another responsible company.
If an independent maintenance contractor's negligent work on facility equipment led to an injury, that contractor may carry independent liability.
A worker may pursue workers’ compensation benefits and, when someone other than the employer or a co-worker is legally responsible, a separate third-party claim. Under Section 5(b) of the Illinois Workers' Compensation Act (820 ILCS 305/5(b)), an employer or workers' compensation insurer holds a statutory lien against any third-party personal injury recovery to recover benefits paid, subject to a statutory deduction of a 25% attorney's fee and a pro-rata share of litigation expenses.
